A BILL to amend article eight-d, chapter sixty-one of the code of West Virginia, one thousand nine hundred thirty-one, as amended, by adding thereto a new section, designated section ten, relating to child endangerment; and providing a criminal penalty for endangering the welfare of children.

Be it enacted by the Legislature of West Virginia:
That article eight-d, chapter sixty-one of the code of West Virginia, one thousand nine hundred thirty-one, as amended, be amended by adding thereto a new section, designated section ten, to read as follows:
ARTICLE 8D. CHILD ABUSE.

§61-8D-10. Endangering the welfare of children.

A parent, guardian, or other person supervising the welfare of a child under eighteen years of age is guilty of a misdemeanor if he or she knowingly endangers the welfare of the child by violating a duty of care, protection or support. Any person violating the provisions of this section is guilty of amisdemeanor, and, upon conviction thereof, shall be fined not more than five hundred dollars, or imprisoned in the county jail not more than twelve months, or both fined and imprisoned.



NOTE: The purpose of this bill is to make endangering the welfare of children a misdemeanor offense.
